the nuclear facility at nyongbyon was closed in 2007 after international talks involving washington. back then its cooling tower was destroyed as a sign of good faith that it wouldn't operate again. that's changed and north korea says a both five megawatt reactor and uranium enrichment facility at nyongbyon will go back online capable of creating enough plutonium for one bomb a year. north korea says the move is to boost electricity and quality and quantity of its nuclear weapons. north korea says it has nuclear weapons it's ready to use and further develop and the world must just accept it. the united states is not acceptable with this and it weighs heavily on south koreans who have to live in the shadow of a neighbor that openly declares its hostility.

the government of seoul is increasingly concerned, promising to respond to any aggression with force. it's unclear how long it will take for north korea to get the nyongbyon facility up and running. north korea says in part it's for electricity. the problem is the plant has never been attached to the power grid. matt? >> richard engel, thank you very much. meanwhile, there is some new information in the shooting death of colorado's prison chief and natalie is here with details on that. >> good morning, matt and savannah. officials now admit the suspected killer in the case should have been behind bars at the time, but he was released due to a clerical error. >> i am confident that they will fix the problem going forward and that it won't happen again. >> reporter: strong words from the district attorney's office after a colorado court admitted that evan ebel was released from prison four years early, he's accused of murdering tom

clements, colorado police chief, a after getting out of prison at the end of january. ebel died after a shoot-out with texas authorities. ebel was already in prison on an eight-year stint for burglary and car theft when he punched a prison guard in 2006. he could have received 12 more years but in a plea deal he was sentenced in 2008 to an additional four years. in a statement from the colorado department of corrections, the court order did not specify consecutive or concurrent sentencing. that led prison officials to impose a sentence that was concurrent, meaning ebel served no additional time for punching the guard. >> i think it's probably worth the effort to go back and make sure we don't have any other cases out there where this problem has occurred before. and now to the rest of this morning's headlines, officials in texas are on alert after the weekend murder of a district attorney and his wife, d.a. mike mclelland and his wife

cynthia were found shot to death in their home on saturday, the killings came two months after his assistant d.a. was assassinated. federal sources say they haven't ruled anything out from a drug cartel to a lone gunman to a white supremacist gang. a tough, new stance on gun control from connecticut. legislators from both sides of the aisle are announcing wide ranging proposals including universal background checks and a statewide dangerous weapon registry. vote can expected today in the state's general assembly. oklahoma's dentistry board is calling for prosecutors to pursue criminal charges against an oral surgeon whose office was found to be using rusty and poorly sterilized instruments, thousands of patients who had seen dr. w. scott harrington were told to get tested for hepatitis b and c as well as hiv. dr. harrington has value tearily given up his license to practice.

break he suffered less than 48 hours ago. nbc's kevin tibbles is in indianapolis with more on that. good morning to you. >> reporter: yes, matt, after such a horrific-looking injury, kevin ware is expected to be released from the hospital here in indianapolis later today just in time to make the bench for this weekend's final four with his team. new pictures show kevin ware up and walking on crutches and visiting with his coach, rick pitino. >> he's done very well. he's very positive. he's not so much focusing on what happened but he's focusing on the recovery. >> reporter: ware's mother lisa was watching the game on tv when her son suffered the devastating injury. >> that is a gruesome-looking injury to kevin ware. >> reporter: while ware's teammates were visibly shaken it was ware who inspired telling them, "win the game, win the game." monday, ware tweeted a picture of his leg telling a fan "i'm

good, bro, i'll be back by next season," all following a two-hour surgery where doctors reset the bone and inserted a metal rod in his right leg. >> i would say that many people with this injury would be able to play basketball again without a problem. >> reporter: athletes around the country have taken to twitter to send their wishes, lebron james, "prayers go out to kevin ware and his family. may you have a speedy recovery kid and come back even stronger." >> i have no doubt he'll be back bigger and stronger. >> reporter: doctors say ware may have had an existing stress fracture prior to the big break, but he's expected to make a full recovery. matt? >> remarkable. kevin tibbles in indianapolis this morning. former nfl great joe theismann knows what kevin ware is going through. he broke his leg in a monday night game in 1985 when he was sacked by linebacker lawrence taylor. the injury so severe it ended his career. joe always good to see you, good morning. >> good morning, matt, good to

be with you. >> it was so hard for all of us to watch this and i'm thinking of you in 1985 and as you watched it, it had to be even tougher. what was your first reaction? >> i was sickened to my stomach. it just conjured up all the memories instantly of what i went threw that evening, the excruciating pain and all of the people around me and all the activity and i saw everybody start to get around kevin. it just kept playing over and over in my mind. those things just don't ever leave you. >> cbs was very careful only to shoot kevin from the waist up during those couple of minutes after he was down, but i was looking at the reactions of the fans and the coaches, and the other players and boy the looks on their faces and the tears in their eyes told you everything they needed to know, didn't they? >> it really did. they tell the full story. i know that when my leg was broken everybody talked about lawrence grabbing his head.

you don't need to see much more. and i agree with you, i thought they did a terrific job of not going deep into the injury, but showing the reaction of everyone. i can imagine coach pitino having it happen right at his feet, literally right at his feet. i know i heard mine break when it happened. sounded like two muzzled gunshots, and it's a sound you never forget. >> so, let me get your perspective, physically he's younger than you were at the time, therapy has come a long way, surgery has come a long way but what do you think he faces physically? >> i think physically the rehabilitation process is not going to be that difficult for him. the rod is going to give him stability and it's just a question of the bone healing as long as there isn't any ankle or knee damage to any extent, i think he'll be fine. >> emotionally? >> emotionally is not a problem. i had a chance to talk to him yesterday and he sounds like he's in a great place. he knows the road will not be easy but he's a young man bound

is now expected to face a judge in a matter of hours. police say he appeared to be on drugs when he smashed into the story rode walmart and jumped out of the car and started attacking people inside. four people were hurt, including a walmart employee. we will have an update on this morning's court hearings at our 11:00 a.m. newscast. happening right now, a cement truck is slowing up the morning commute in the south bay. live pictures from our chopper. this is southbound interstate 280, a connector ramp to the northbound highway, 101 in san jose. the cement truck is on its side. that is making it rough out there. nobody was hurt. we are happy to report. the chp has issued a significant alert for that area. to get more, let's check in with anthony slaughter with a look at the roads. >> you can see that's the accident. this is a 101 northbound with the head lights facing toward us and all of that slow-going is

should be held liable for the singer's death. >> the trial is really going to come down to did aeg have sufficient control over dr. murray to encourage dr. murray to treat michael jackson in an improper way. >> reporter: katherine jackson is suing the tour promoter for negligence, claiming the company pushed michael too hard, threatened to cancel the tour if he missed rehearsal and forced him to accept treatment from dr. conrad murray, the man convicted of involuntary manslaughter for the 2009 death of the king of pop. attorneys for aeg argue they merely had a performance agreement with jackson to put on a tour and was in no way responsible for the singer's health or death. michael's two older children, prince and paris, will reportedly take the stand, as well as katherine. the potential witness list also features serious star power including prince, quincy jones,

we're back, 8:09, star jones, donny deutsch and dr. nancy snyderman, are itching to talk about the stories that have you talking. let's talk about kevin ware and the horrific injury in the game louisville against duke, he was the guard who went down trying to block the shot, with the compound fracture of his leg. now, he went down on the sideline and in the 45 seconds that followed him falling to the ground cbs stayed on a shot from the waist up. and during that time, they were in the control room they're trying to figure out what they have in terms of a replay. 45 seconds later they show us two replays from different angles. how did you think cbs handled it? >> initially, i actually thought they did very well. obviously, during a live broadcast of a sporting event, you follow what the action is on the court, but then they made a good decision to only shoot him from the waist up and also to get the great reactions from the fans and the players.

>> donny? >> i thought they handled it perfectly. in reality you're showing a news event. and you're going to reshow it. they're taking it in for the first time and once they saw it the second time, wow, they pulled back so i don't think from cbs's point of view they could have done much differently. >> nancy, let me say this, they had the 45 seconds and before they replayed that shot the first time, they did not, however, say to the audience, "if you missed it, what you're about to see is horrific." they did not warn the audience. how did you feel? >> i don't think they had to warn the audience. and here's why. all you had to do is look at the silence, the look on people's faces, the fact that the color commentator said people have become visibly ill looking at this, and i was watching the game live, looked down and didn't see it, looked up, i wanted to see it. i admit as a physician i also wanted to see it.

that was the company that was promoting michael jackson's concert tour at the time he died. it's a wrongful death lawsuit, among the things that she is claiming is negligent hiring of dr. conrad murray, the man who is serving four years in prison right now for involuntary manslaughter. the price tag we're hearing of this lawsuit, $40 billion. go ahead. >> well, i can tell you that that's the only cause of action that's still there is negligent hiring. a lot of them have already been dismissed. in essence the company hired conrad murray, conrad murray was an employee of the company. he didn't do his job effectively and so the family, the estate is suing. >> did michael jackson want conrad murray? >> yes, absolutely. there's no question as to whether or not michael jackson wanted conrad murray but who was conrad murray, the boss, excuse me, the employee of? was he michael jackson's employee or was he aig's employee? that's the argument. >> we're already off the point i'm trying to make here $40 billion. >> okay, you want me to go for the money.

it was really, really hard. she wouldn't let us hold her or kiss her and i'm here today because within six months, by the time we finalized her adoption she was completely transitioned, and loving and attentive and attached, and that's the fear that people have. >> that's the fear you speak to in this book, i know that's why you're coming out because i think people are afraid to adopt an older child out of fear there may be some damage that's irreparable and you're here to say that's not true. >> it's strange, isn't it, we'd be more likely to take in a dog we found in the street. i say in the book a dog who could eat your face while you're asleep and yet here are these children and there are so many children, 130,000 legal emancipated children in the u.s., children in every country that need a home, so i always say if you're looking to adopt in the u.s., follow the laws of your state, it's different for every state and if you're looking to go abroad, please do, go wherever you think your child is. >> nia vardalos, it's great to

put in that tax return, file that tax return on time, that's the best thing you can do. >> and the reason for that and people need to hear this, that if you fail to file a return, the penalty is greater than if you can't pay. >> it's ten times greater, if you fail to file you pay 5% of that unpaid tax bill plus interest every month. if you just are unable to pay, that failure to pay penalty is only half a percent plus interest every month. >> say you need to file an extension. how much time does that buy you? >> it buys you six months but you got to do it by april 15th. you still have to file for that extension by the tax filing deadline and do you not have to file your return until october 15th. >> you file for an extension and two things you can do, you can call the irs, who do you ask for and what do you tell them? >> you can ask for someone. the fact is to go on irs.gov and try to set up an installment agreement right there, that's the best bet for many people.

>> if you end up talking to a human being do you give them the reasons that you're unable to pay your irs bill? >> you probably have many reasons you're unable to pay. what the irs wants to know and they say this on the online form as well they want to know the highest amount that you can pay every month and when you'll be able to pay it. that's what they really want to know and once you're able to do that you can apply for this online, this installment agreement and have it set up in minutes. >> very easy. you want people to be aware especially at this period of time where they're vulnerable that there are scams out there. talk to me about that. >> there are scams out there and a lot of people are preying on folks who may be having some trouble paying their taxes or may be unaware of how to go through the process. one of the biggest scams out there of course is identity theft and the irs has been working diligently trying to get rid of identity theft but it's out there, people trying to take your social security number or other information on your return to file a return or try to get a claim, claim a refund. >> at the bottom of the screen

it says the irs never uses e-mail to contact taxpayers about tax issues so if you get an e-mail claiming to be from the irs, it's not from the irs. >> it's not from the irs, that's a phishing scam. if they want to contact you, they will contact you but they'll send you a letter. >> we get a lot of e-mails over the last couple of days about filing taxes and this one, more than half of all small businesses work from home and here's a common worry tweeted actually by gary, he tweets, is a home office deduction an automatic audit? >> so many people worry about this. this is not necessarily true. in fact normally if you have a home-based business you use a percentage of your home, a space in your home, a room in your home exclusively for work, then you are able to claim the home office deduction. what trips people up, it is a complicated process. you need to figure out the percentage of the square footage in your home that is used for the home office and the percentage of expenses that are used for this home office work,

you're standing now. two officers from lapd, lafayette police, responded a little after 7:00 this morning to those calls. as they approached the house, they tell us a 28-year-old man who lives there came out with a knife. it's not clear what was said between him and the police, if anything. at least one of the officers fired at least two to three shots. at least one of those shots hitting the suspect. that suspect is in surgery right now. the chief of police tells us he is expected to survive. police haven't told us why he approached with a knife and they are not telling us what led up to the 911 hangups. they did notice some of the windows on the house had been broken before they arrived. the please are interviewing three other people at home at the time. we spoke with a neighbor who knows the family that lives there. he tells us the mom and dad are out of town, in mexico, but he believes at least one adult daughter, an adult son and a live
